The short version
- A monthly subscription you can cancel any time. You keep the Service to the end of the month you paid for.
- Use it at the venue you signed up. Don’t share your venue code with another venue.
- You look after your equipment, how it’s mounted, and axe-throwing safety at your venue.
- Our liability is capped at the fees you paid in the last 12 months. Saskatchewan law applies.
The summary is here to help. The full terms below are what apply.
This agreement
These terms are an agreement between your business (“you”, the venue) and 102190362 Saskatchewan Ltd., operating as District 306 and Nitro Axe (“we”, “us”), Regina, Saskatchewan, Canada. They cover the Nitro Axe software, the desktop app, nitroaxe.com and our support (together, the “Service”). By signing up or using the Service you agree to them, and if you sign up for a business, you confirm you’re allowed to agree for it.
The Service
Nitro Axe runs interactive games projected onto axe-throwing targets, with scoring on lane tablets and tools for your staff. The Service is for businesses, not personal or household use. Your plan (Core, Plus or Pro) decides which games you can use. We may improve, change or retire games and features over time; we won’t take away the core of what your plan includes without telling you first.
Your subscription and payment
- Billing: plans are billed monthly in advance, in US dollars, through our payment provider Stripe, starting on the day you sign up. Prices are shown on nitroaxe.com and at checkout, plus any sales tax that applies.
- Renewal: your subscription renews each month until you cancel.
- Cancelling: you can cancel at any time from the “Manage your subscription” link in your welcome email, or by emailing us. You keep the Service until the end of the month you’ve paid for. We don’t refund part-months.
- Failed payments: if a payment fails, Stripe will try again. If it’s still unpaid after that, we may pause your venue code and the Service until it’s paid.
- Price changes: we’ll give you at least 30 days’ notice by email before your price changes. You can cancel before it takes effect.
Your licence
While your subscription is paid, you may install and use the Nitro Axe app on the computers at the venue you signed up, for your own customers. You may not resell, rent or share the Service or your venue code with another venue; copy, change, or reverse-engineer the software; or try to get around plan limits or payment. The software, games, artwork and names stay ours; this is a licence to use them, not a sale.
Your venue, equipment and guests
- Equipment: you choose, buy, install and look after your own equipment: computers, projectors, mounts, tablets, Wi-Fi and wiring. Our setup guide is general advice. Have projectors and mounts installed securely, following the manufacturer’s instructions and local rules, by a qualified installer where needed.
- Safety: you run axe throwing at your venue and are responsible for its safety: lane design, supervision, waivers, insurance and following the law and your local axe-throwing rules. The Service is entertainment software; it doesn’t make axe throwing safe and isn’t a safety system.
- Your branding: you’re responsible for what you upload (your logo, colours and venue name) and confirm you have the right to use it. You let us use it to run the Service for you.
Updates and support
We release updates through the app. Support is by email at [email protected]; we aim to reply within one business day. We work to keep the Service running well, but we can’t promise it will never have a problem or a pause, for example when the internet, a computer or a projector fails.
Disclaimer
Apart from what these terms say, the Service is provided “as is” and “as available”, and to the extent the law allows we give no other promises or warranties, including that it fits a particular purpose or will be uninterrupted or error-free.
Limit of liability
To the extent the law allows: we aren’t liable for indirect or consequential losses, such as lost profits, lost bookings or lost data; and our total liability for anything to do with the Service is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law.
Ending the agreement
You can end it by cancelling your subscription. We can suspend or end it if you seriously break these terms (for example, not paying or sharing your code with another venue) and don’t fix it within 14 days of us telling you, or straight away where the law allows. When it ends, the app stops working with your venue code.
Changes to these terms
We may update these terms. If a change matters, we’ll email you at least 30 days before it applies. If you keep using the Service after that, the new terms apply; if you don’t agree, you can cancel.
Law
These terms are governed by the laws of Saskatchewan and the federal laws of Canada that apply there, and the courts of Saskatchewan decide any dispute.
